Terms of Service

These Terms of Service have been updated in preparation for the launch of Photo Assignments.

Material changes include:

1. The contracting Party. Camera Setup has transitioned from a sole proprietorship to a private limited company. Camera Setup Services B.V. is now the contracting party.

2. Clause 6 (Community Behavior & Content Guidelines). Expanded to clarify rules on use of others’ content, prohibit commercial use, address metadata responsibility, prevent misuse of the Community Platform, and restrict content at Camera Setup’s sole discretion where it conflicts with law, good morals, or public order.

3. Clause 11 (Limitation of Liability). Expanded to add participant indemnification for third-party claims, and to clarify liability exclusions regarding accidents, injuries, property damage, privacy claims, law violations, and conduct of others.

Other adjustments were clarifications or compliance alignments and do not materially change participants’ rights or obligations.

General Provisions

These Terms of Service (“Terms”) govern the provision and use of Photo Assignments offered by Camera Setup Services B.V. (“Camera Setup”, “we”, “us” or “our”), a private limited liability company registered in Amsterdam, the Netherlands, and registered with the Dutch Chamber of Commerce under number 98437674.

By subscribing to, accessing or completing photo assignments, interacting or submitting content to the community gallery hosted via the community platform, or otherwise using the Photo Assignments services (collectively, “participation” or “participating”), you (the “participant”, “you”, or “your”) expressly agree to be bound by these Terms.

These Terms apply equally to all actions and services of Camera Setup related to Photo Assignments, including but not limited to the distribution of assignments and the management of the community gallery.

By participating, you acknowledge and agree that Camera Setup collects, stores, and processes certain personal data in accordance with applicable privacy laws. The processing of your personal data is governed by our Privacy Statement, which explains what information is collected, how it is used, and your rights regarding your personal data. By using our services, you consent to the collection and processing of your personal information as described in our Privacy Statement.

If any provision of these Terms is deemed invalid or unenforceable by a competent authority, such provision shall be severed without affecting the validity and enforceability of the remaining provisions. The remaining provisions shall remain in full force and effect.

Camera Setup reserves the right to amend or update these Terms at any time at its sole discretion. Any material changes to these Terms will be communicated to participants. Continued participation following such notification constitutes acceptance of the updated Terms.

1. Substack Terms & Privacy

Your subscription to our newsletter is handled by Substack. Substack’s Terms of Service and Privacy Policy apply to your subscription and use of the platform. You may review these here:

We do not control Substack, and Substack stores your personal data. Check our Privacy Statement for more information.

2. Padlet Terms & Privacy

Access to the Community Gallery is provided by the Community Platform Padlet. Use of Padlet requires creating an account, and Padlet’s Terms of Service and Privacy Policy apply to your use of their platform. You may review these here:

We do not control Padlet, and Padlet stores your personal data. Check our Privacy Statement for more information.

3. Minimum Age

You confirm that you are at least 18 years old. If you are under 18, you may not participate. We do not knowingly collect personal data from children under 18.

4. Voluntary Participation & Personal Responsibility

Participation is voluntary. You are responsible for:

• Ensuring your participation complies with applicable laws, regulations, and the rights of others, including safety and legal requirements.

• Maintaining the security and confidentiality of your Substack and Padlet accounts, including credentials and uploaded content.

• Understanding the disclaimers and limitations outlined in these Terms, including clause 11 (Limitation of Liability).

5. Photo Uploads and Community Gallery

When you submit a photo or other content to the Community Gallery:

• License: You grant Camera Setup a non-exclusive, worldwide, royalty-free license to display, distribute, and use your submissions for educational, promotional, or community purposes, including in emails, social media, or galleries. You retain full copyright.

• Public access: Content you submit may be publicly visible to other participants. Others may view, save, or share your photos or text.

• Personal responsibility: You confirm that you own the copyright or have permission to share any content you submit, including any necessary model or location releases.

• No obligation: Participation is voluntary. You are not required to participate.

• Moderation: We reserve the right to remove submissions at any time at our discretion.

• Compliance with Community Guidelines: All submissions must comply with clause 6.

6. Community Behavior & Content Guidelines

To maintain a safe and creative space, please ensure your submissions and interactions:

1. Respect copyright and intellectual property rights. Submit only your own work or content you are authorized to share.

2. Do not include illegal, offensive, misleading, or harmful material (including hate speech, harassment, or graphic content). The content may not be in conflict with the law, good morals or public order, such to the sole scrutiny of Camera Setup.

3. Do not post spam, abusive, or disruptive content.

4. Treat other participants respectfully and engage constructively.

5. Do not download, copy, distribute, or otherwise use content submitted by other participants without their explicit permission. All rights in submissions remain with the original creator.

6. Do not exploit the Community Gallery for commercial purposes (e.g., advertising or promotions) without prior written consent.

7. Ensure that you have obtained any required consent from identifiable people featured in your photos and permission to photograph private property or restricted locations.

8. Be mindful of metadata (e.g., EXIF data such as location) in your submissions; you are responsible for removing any personal or sensitive data you do not wish to share.

9. Do not misuse the Community Platform, attempt to bypass security measures, or otherwise interfere with the functioning of the services.

Camera Setup reserves the right to remove any content or restrict access for violations at any time.

7. Account Responsibility on Community Platform

If a Community Platform account (e.g., Padlet) is required:

• You are responsible for creating and managing your account.

• All Community Platform legal terms and policies apply in addition to these Terms.

• You are solely responsible for activity on your account and keeping credentials secure.

8. Third-Party Content & Platforms

The newsletter and Community Platform may contain links to third-party services or websites. We do not control and are not responsible for the content, privacy practices, or policies of third parties. You should review and agree to third-party terms independently.

9. No Professional Advice & Disclaimer

All content, tips, and example images are provided for creative inspiration only.

• No guarantees: We do not guarantee outcomes, awards, or recognition for submissions.

• Risks: Participation is voluntary. You are responsible for your own safety while photographing or creating content.

• Platform limitations: We are not responsible for technical issues, lost content, or unauthorized access on Substack or the Community Platform or the Community Gallery.

• No warranties: All content and services are provided “as is” without warranties of any kind, whether express or implied.

10. User Feedback & Suggestions

Any feedback, comments, or suggestions you provide to Camera Setup are non-confidential and may be used freely for any purpose, including improving or promoting our services, without compensation to you.

11. Limitation of Liability

The participant shall indemnify Camera Setup against and will not hold Camera Setup liable for any damages ensuing from any claims made by third-parties in relation to their participation. To the fullest extent permitted by law, Camera Setup is not liable for any damages arising from your participation, including but not limited to:

• Technical issues, lost content, unauthorized access, or data breaches involving Substack, Padlet, or other third-party providers.

• Copyright, other intellectual property claims, or privacy claims, including but not limited to claims by others regarding your submissions.

• Any claims, complaints, disputes, or liabilities arising from your actions while participating, including but not limited to photographing people, private property, or from any violation of applicable laws or regulations.

• Any accidents, incidents, injuries, or property damage, whether affecting yourself, others, your own property, or the property of others, occurring during or as a result of your participation.

• Any damage, loss, or claims resulting from the conduct, negligence, or actions of others, including but not limited to other participants or third-party platforms.

• Any risks, hazards, or consequences arising from your decision to follow assignment themes or instructions; you are solely responsible for assessing and ensuring your own safety.

• Indirect, incidental, special, or consequential damages.

You acknowledge that you participate voluntarily and are solely responsible for your actions and compliance with applicable laws. You acknowledge that once your content is made available to others, Camera Setup cannot control how it is used.

Liability, if any, is limited to fees paid for the subscription during the three months prior to the claim.

12. Technical Limitations & Force Majeure

Camera Setup is not responsible for:

• Lost, corrupted, or unauthorized access to submissions.

• Delays or failures caused by circumstances beyond our reasonable control, including technical failures, cyberattacks, government actions, natural disasters, or other force majeure events.

13. Unsubscribing and Content Removal

Participants may stop to participate at any time by unsubscribing. The content you uploaded to Substack, Padlet or any other third-party service provider may also remain stored according to the respective third-party’s policies. You are responsible for removing content via these platforms if desired. Substack, Padlet or any other third-party service provider may also enforce their own rules independently.

14. Refunds & Fees

Subscription fees or payments are non-refundable, unless required by applicable law.

15. Governing Law & Jurisdiction

These Terms are governed by the laws of the Netherlands. Any disputes will be resolved in the courts of Amsterdam, the Netherlands.

16. Applicability

These Terms govern the (subscription) agreement between you and Camera Setup. These Terms do not apply to third-party websites. Camera Setup advises subscribers to consult the terms of these third parties on their respective websites.
